2. Collection of personal data

In this article, we have compiled the types of data we process in the following cases, for which purpose the data is processed and how it is used:

2.1 Job seekers/Applicants/Online database

When you contact us to receive employment offers, to register as an applicant on our online database or to send us your application documents, we collect the following information:

- title,
- academic degree,
- first name and surname,
- address,
- date of birth,
- religious denomination,
- email address,
- telephone number (landline and/or mobile),
- tasks requested/scope of employment,
- education,
- professional career,
- other information and documents which you provide to us,
- other information which you provide on our platform e.g. as an attachment to your data entry,
- your photo, if applicable,
- information about your new job facilitated by us, your employer and your current employment contract

We only collect data which we receive directly from you e.g. through our online applicant database, through your direct submission of data to us and/or through your application.

This data is collected for the following purposes:

- to identify you as a potential candidate,
- to be able to adequately advise you when seeking employment,
- for correspondence with you, particularly regarding recruitment measures,
- to automatically match the data from your application with requirements of vacancies, whereby data comparison decisions are made by of our employees, relating to the selection of individual case search criteria and to recommendations to potential employers,
- to forward your application data to potential employers, with your prior consent and to advise potential employers on how to fill vacancies,
- to invoice clients,
- to enforce legal rights of clients or to defend claims of clients,
- if applicable, to fulfil and conclude contracts between yourself and our company.

Data processing is based on your request and is in accordance with Art. 6, para. 1, sentence 1, let. (b) of the GDPR for the processing of your request for the application of vacancies and possibly for the bilateral provision of contractual obligations.

Your data will only be disclosed to potential employers for the aforementioned purposes if you give us your explicit consent. A disclosure for purposes other than those mentioned above will not occur.
We will delete your data five calendar years after the year of your last entry or contact with us. In the event and insofar as we are obliged to store your data for a longer period of time for the fulfilment of tax and commercial storage and documentation obligations, we will store your data beyond the aforementioned duration until the end of the respective prescribed statutory deletion period. The legal basis for this is Art. 6, para. 1, sentence 1, let. (c) of the GDPR.

2.2 Clients/Employers

If you are a client of ours and have commissioned us with recommendations for staffing or recruitment, we collect the following personal data:

- first name and surname of the contact person for the client,
- company/carrier/business address,
- telephone number and/or mobile number,
- email addresses of the contact persons,
- other data that you provide us with.

Data processing is generally based on your request and is in accordance with Art. 6, para. 1, sentence 1, let. (b) of the GDPR; it is required for processing your request to provide our services. If we receive your data from other sources - e.g. via recommendations, from the internet or via corporate online networks - the legal basis is Art. 6, para. 1, sentence 1, let. (f) of the GDPR. We hereby have a legitimate interest in client acquisition and the search for possible vacancies for job-seeking applicants.

The collection of this data is for the following purposes:

- to provide you with our services and to recruit potential employees for you,
- to contact you and to acquire client orders,
- for advertising purposes regarding our range of services,
- if applicable, to fulfil and conclude contracts between yourself and our company,
- for invoicing,
- to comply with tax and other legal obligations,
- if necessary, to enforce and defend legal claims.

Your data is processed with your consent according to Art. 6, para. 1, sentence 1, let. (b) of the GDPR in relation to screening for employer offers only in as far as is necessary to fulfil mutual contractual obligations.

We will delete your data five calendar years after the year of your last entry or contact with us. In addition, we will only save and store client data beyond this period of time if we are required to do so to fulfil our tax and commercial storage and documentation obligations, in accordance with Art. 6, para 1, sentence 1, let. (c) of the GDPR.

2.3 Visitors to our website

When you visit our website www.lehrcare.de, your device browser automatically sends information to the server of our website. This information is temporarily stored in a log file. The following information will be collected without your assistance and stored until automated deletion:

- IP address of accessing computer,
- date and time of access,
- name and URL of the retrieved file,
- website from which access is made (referrer URL),
- the browser used and if applicable, the operating system of your computer as well as the name of your access provider.

The stated data is processed by us for the following purposes:
- to ensure smooth operation of the website,
- to ensure ease of use of our website,
- to assess system security and stability
- for additional administrative purposes.

The legal basis for data processing is Art. 6, para. 1, sentence 1, let. (f) of the GDPR. Our legitimate interest is in the data collection purposes listed above. In no case is the collected data used to draw conclusions about your person.

In addition, cookies and analysis services are used when visiting our website. Further details relating to these can be found in sections 4 and 5 of this data protection policy.

Cookies

We use cookies on our website. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.,) when you visit our website. Cookies do not damage your device, contain no viruses, Trojans or other malware.
Information, which comes from the specific device that has been used, is stored in the cookie. However, this does not mean that we are aware of your identity.
The use of cookies, serves to make our offer more accessible and pleasant for you. For this, we use so-called session cookies to recognise that you have already visited individual pages on our website. These are automatically deleted when you leave our website.

To optimise user-friendliness, we also use temporary cookies which are stored on your device for a specific period of time. If you visit our website again to use our services, these will automatically recognise that you have previously visited us and identify entries and settings you entered before, so that there is no need for you to re-enter them. We also use cookies to statistically record the use of our website and to evaluate the data for the optimisation of our offer. These cookies allow us, upon a return visit by you to automatically recognise that you have previously visited our website. These cookies are deleted automatically on an annual basis.

The data processed through these cookies is used for the purposes mentioned above, in order to ensure our legitimate interests, as well as those of third parties, according to Art. 6, para. 1, sentence 1, let. (f) of the GDPR. Legitimate interests reside in the aforementioned purposes of the use of cookies. Most browsers accept cookies automatically. However, you can set your browser to not store cookies on your computer or to be notified if a new cookie should be set. However, disabling cookies completely may lead to inactivation of certain features of the website.

Social Media Plugins

Our website uses social media plugins from the social networks Facebook and Twitter, in accordance with Art. 6, para. 1, sentence 1, let. (f) of the GDPR, to promote our offer. Responsibility for the operational compliance with data protection regulations lies with the respective providers.

Facebook

On our website, we use social media plugins from Facebook to promote our offer to potential job-seekers and employers. We use the "LIKE" or "SHARE" button for this. This is an offer from Facebook.

When you visit a page of our website which contains such a plugin, your browser establishes a direct connection to the Facebook servers. Content of the plugin is directly transmitted to your browser by Facebook and thereby incorporated into the website.

By incorporating the plugins, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are currently not logged into your Facebook account. This information (including your IP address) is transmitted from your browser directly to a Facebook server in the USA and stored there.

If you are logged into Facebook, Facebook can ascribe your visit to our website directly to your Facebook account. If you interact with the plugins, for example by pressing the "LIKE" or "SHARE" button, the corresponding information is also directly transmitted to a Facebook server and stored there. The information will also be posted on Facebook and displayed to your Facebook friends.

Facebook may use this information for advertising purposes, market research and need-based website design. For this purpose, Facebook collects usage, interests and relationship profiles, for example, to evaluate your use of our website in relation to the advertisements displayed on Facebook, to inform other Facebook users about your activities on our website and to provide other services related to the use of Facebook.
If you do not want Facebook to ascribe the data collected via our website to your Facebook account, you must log out of your Facebook account before visiting our website.

Twitter

Plugins from the Twitter Inc. (Twitter) network are integrated into our website. The Twitter plugins (Tweet Button) can be recognised by the Twitter logo on our website. You can find an overview of the Tweet Buttons here.

When you visit a page of our website that contains such a plugin, a direct connection is established between your browser and the Twitter server. The allows Twitter to receive the information that you have visited our website with your IP address. If you click on the Twitter "Tweet Button" while you are logged into your Twitter account, you can link the contents of our pages to your Twitter profile. This allows Twitter to ascribe your visit to our pages to your Twitter user account. We, as the provider of the pages, are not aware of the content of the transmitted data and the use by Twitter. If you do not want Twitter to ascribe your visit to our pages, please log out of your Twitter account before visiting our website.

Tracking-Tools: Google Analytics

To customise and continually optimise our pages, we use Google Analytics, a web analytics service provided by Google Inc.Google Inc. (1600 Amphitheater Parkway, Mountain View, CA 94043, USA, hereinafter referred to as "Google"). In this context, pseudonymised usage profiles are created and cookies are used. The information generated by the cookie about your visit to this website includes:

- browser type/version,
- operating system used,
- referrer URL (the previously visited page),
- host name of the accessing computer (IP address),
- time of the server request.

This data is transmitted to a Google server in the US and stored there. The information is used to evaluate the use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage for the purposes of market research and need-based website design.

These tracking measures are in accordance with Art. 6, para. 1, sentence 1, let. (f) of the GDPR. With the utilised tracking measures, we want to ensure a need-based design and the continuous optimisation of our website. We also use tracking measures to statistically record the use of our website and to evaluate the data for the purpose of optimising our offer for you, the client. These interests are to be regarded as justified within the scope of the aforementioned regulation.

This data may also be disclosed to third parties if required by law or to third parties processing this data by proxy. Under no circumstances will your IP address be merged with any other data provided by Google. The IP addresses are anonymised, so that assignment to an individual is not possible (IP masking).

You can prevent the installation of cookies by setting your browser software accordingly. However, we would like to point out that in this case, not all features of this website may be comprehensively utilised. You can also prevent the collection of data generated by cookies and related to your use of the website (including your IP address) and the processing of this data by Google, by downloading and installing a browser add-on .

As an alternative to the browser add-on and specifically in the case of mobile device browsers, you can prevent the collection by Google Analytics by clicking on this link. An opt-out cookie will be set that prevents future collection of your data when you visit this website. This opt-out cookie is only valid in this browser and only for our website and is stored on your device. If you delete the cookies in this browser, you must reset the opt-out cookie.

2.4 Suppliers

We also use data from our suppliers and business partners, which we commission ourselves:

- first name and surname of the contact person for the client,
- company address,
- telephone number and/or mobile number,
- email addresses of the contact persons,
- other data that you provide us with.

The data processing, in accordance with Art. 6, para. 1, sentence 1, let. (b) of the GDPR, is based on your request and is required for the completion of the contract, as well as to fulfil our legal and tax obligations in accordance with Art. 6, para. 1, sentence 1, let. (c) of the GDPR.

The collection of this data takes place:

- to contact the suppliers or business partners,
- if applicable, to fulfil and conclude contracts between yourself and our company,
- to comply with tax and other legal obligations,
- if necessary, to enforce and defend legal claims.

A disclosure of your data does not occur, unless you have expressly given us your consent in individual cases. If you receive a subcontract from us as a personnel service provider, we disclose your data to our clients and (potential) applicants, as far as this is required for the task.

We will delete the relevant personal data if there is no business contact for five full calendar years. Additionally, we will only save and store your data to the extent that we are required to do so for tax and commercial storage and documentation obligations in accordance with Art. 6, para. 1, sentence 1, let. (c) of the GDPR or if you have given your express consent for longer storage according to Art. 6, para. 1, sentence 1, let. (a) of the GDPR.

3. Rights of affected persons

You have the following rights regarding the abovementioned cases,

- to, at any time, revoke consent to the data processing, which you have given us, according to Art. 7, para. 3 of the GDPR. This results in us not being allowed to continue the data processing based on this consent in the future;
- according to Art. 15 of the GDPR, to request information about your personal data processed by us. In particular, you may request information about the processing purposes, the category of personal data, the recipients to whom your data has been disclosed, the planned storage duration, the right of rectification, deletion, limitation of processing or right of appeal, the right to objection, to request the origin of the data if it was not collected by us, as well as the existence of automated decision-making including profiling and where appropriate, significant information about the details;
- according to Art. 16 of the GDPR, to demand the immediate correction of incorrect or incomplete personal data stored by us;
- according to Art. 17 of the GDPR, to request the deletion of your personal data stored by us, as far as the processing is not required for the exercise of a right to freedom of expression and information, to the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims of third parties;
- according to Art. 20 of the GDPR, to receive your personal data, which you provided to us, in a structured, current and machine-readable format or to request disclosure to another responsible body;
- and according to Art. 77 of the GDPR, to make a complaint to a supervisory authority. Generally, you can contact the supervisory authority of your usual place of residence or workplace or the supervisory authority at our headquarter in Berlin.

4. Right of objection

Insofar as your personal data is processed based on legitimate interests according to Art. 6, para. 1, let. (f) of the GDPR, you have the right, according to Art. 21 of the GDPR, to object to the processing of your personal data, as far as there are reasons for this, which arise from your particular situation.
